1. Introduction
These Terms of Service govern your access to and use of the Pilotbot platform, website, software, and related services provided by LLC Gekko Tehnology Thailand ("Company," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.
2. Definitions
- "Service" — the Pilotbot platform, website, software, APIs, and all related features and functionality.
- "Platform" — the technical infrastructure and software operated by the Company.
- "User" — any individual or entity accessing or using the Service.
- "Account" — a registered user profile created to access the Service.
- "Subscription" — a paid plan granting access to Service features for a defined period.
- "API Key" — credentials issued by a third-party exchange and provided by the User to enable Service integrations.
- "Exchange Account" — a user account on a third-party cryptocurrency exchange connected to the Service.
- "Content" — any information, data, text, or material submitted to or generated by the Service.
- "Third-Party Services" — external platforms, providers, and systems the Service may depend on or integrate with.
- "Bot" — the automated system within the Service that manages P2P advertisement operations.
- "Support Services" — assistance provided by the Company related to the use of the Service.
3. Who We Are

4. Eligibility
You must be at least 18 years old to use the Service. You represent that you have the legal capacity to enter into a binding agreement under the laws applicable to you.
5. Description of the Service
Pilotbot is a technical platform that enables users to configure, automate, and manage certain P2P advertisement operations and related workflows on supported third-party exchanges. The Service is provided for automation and management purposes only.
6. Nature of the Service
The Company is not:
- a broker,
- an exchange,
- a custodian,
- a financial institution,
- an investment adviser,
- a tax adviser,
- a legal adviser.
The Service does not provide financial, legal, tax, compliance, or investment advice and does not guarantee profits, trading outcomes, or business results.
7. Account Registration
Users may be required to register an account and provide accurate, complete, and current information. Users are responsible for maintaining the confidentiality of their login credentials and for all activity under their account.
8. Exchange Integrations and API Permissions
The Service may require integration with third-party exchanges through API credentials. Users are solely responsible for generating, configuring, and maintaining their API credentials. The Service is intended to use API permissions limited to read access and advertisement management only. Users must not provide API credentials with withdrawal permissions or broader permissions than necessary.
9. No Access to Customer Funds
The Company does not access, hold, receive, control, or custody customer funds. The Service does not perform withdrawals, custody operations, or direct asset transfers on behalf of users.
10. User Responsibilities
Users are solely responsible for:
- the legality of their activities in their jurisdiction,
- exchange account compliance,
- taxes,
- local financial and reporting obligations,
- KYC/AML obligations applicable to them,
- sanctions compliance,
- ad settings,
- content submitted to the Service,
- the security of their exchange account, email, devices, passwords, and 2FA.
11. Prohibited Uses
Users may not use the Service for:
- unlawful activity,
- fraud,
- sanctions evasion,
- money laundering or unlawful financial schemes,
- use of stolen, false, or unauthorized identities,
- use of third-party credentials without authorization,
- account sharing contrary to platform rules,
- attempts to interfere with the Service,
- reverse engineering except where prohibited by law,
- abuse of exchange systems,
- any activity that may expose the Company, other users, or service providers to legal, operational, or reputational risk.
12. Marketing and Communications
Users may receive transactional communications related to the Service. Marketing communications may be sent where permitted by law or where the user has opted in, and users may unsubscribe as described in the Privacy Policy.
13. Subscription, Billing, and Renewals
The Service is offered on a subscription basis. Billing occurs on a recurring cycle according to the selected plan. Subscriptions renew automatically unless cancelled before the renewal date. Payments are processed through third-party payment providers. Applicable taxes and fees may apply based on your jurisdiction. Access may be suspended for non-payment. Pricing changes will be communicated in advance with reasonable notice.
14. Refund Policy
Users may request an unconditional refund within 24 hours of the original purchase. After a refund is processed, access to the Service may be terminated or suspended. 15. Third-Party Services
The Service may depend on third-party exchanges, payment processors, cloud providers, analytics providers, email services, AI providers, and other external systems. The Company is not responsible for outages, changes, restrictions, bans, interruptions, delays, incompatibilities, or failures caused by Third-Party Services.
16. Availability and Service Changes
The Company may update, modify, suspend, restrict, or discontinue any part of the Service at any time, with or without notice, where reasonably necessary.
17. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis to the maximum extent permitted by applicable law. The Company disclaims all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, accuracy, reliability, and freedom from errors.
18. No Guarantee of Results
The Company does not guarantee:
- profitability,
- trading results,
- market position retention,
- uninterrupted automation,
- exchange compatibility,
- accuracy of third-party data,
- absence of losses,
- absence of account restrictions or blocks by third parties.
19. Limitation of Liability
To the fullest extent permitted by law, the Company shall not be liable for indirect damages, incidental damages, special damages, consequential damages, loss of profits, loss of revenue, business interruption, loss of opportunity, reputational loss, or data loss resulting from third-party failures or user misconfiguration.
If liability cannot be excluded, the Company's total aggregate liability shall be limited to the amount paid by the user for the Service during the limited period preceding the claim, to the maximum extent permitted by law.
20. Indemnification
Users agree to indemnify and hold harmless the Company and its officers, employees, affiliates, contractors, and service providers from claims, losses, liabilities, damages, costs, and expenses arising out of user misconduct, unlawful use of the Service, breach of these Terms, violations of third-party rights, or misuse of exchange credentials or integrations.
21. Security
The Company may implement reasonable administrative, technical, and organizational safeguards. However, no method of transmission, storage, or security is guaranteed to be completely secure. Users remain responsible for their own security posture.
22. Suspension and Termination
The Company may suspend, restrict, or terminate access where it reasonably believes that the user violated these Terms, the user creates legal or operational risk, unlawful conduct is suspected, fraud or abuse is suspected, sanctions exposure exists, or platform integrity may be compromised.
23. Intellectual Property
All intellectual property rights in the Service, software, branding, site materials, and related content remain the property of the Company or its licensors. Users receive only a limited, revocable, non-exclusive, non-transferable license to use the Service in accordance with these Terms.
24. User Content and Feedback
Users retain rights to their own submitted content where applicable, but grant the Company the limited rights necessary to operate, maintain, improve, and support the Service. Feedback may be used by the Company without restriction or compensation.
25. Privacy
Use of the Service is also governed by the Privacy Policy and Cookie Policy, which form part of the legal framework of the Service.
26. Account Deletion
Users may request or initiate account deletion as made available in the Service. Deletion may be subject to retention obligations, fraud-prevention needs, dispute handling, and legal compliance.
27. Changes to These Terms
The Company may update these Terms from time to time. Continued use of the Service after the effective date of updated Terms constitutes acceptance of the revised Terms where permitted by law.
28. Governing Law and Dispute Resolution
These Terms shall be governed by the laws of Thailand, without regard to conflict of laws principles. Disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Thailand.
